Generative AI Terms of Use

RGBKit provides a suite of generative AI tools including AI image generation, image transformation, AI writing, PDF processing, and video editing tools (collectively, the "RGBKit AI Platform").

These Generative AI Terms of Use ("AI Terms") supplement RGBKit's general Terms and Conditions and Privacy Policy. By accessing or using any generative AI feature on RGBKit, you agree to these AI Terms in addition to the general Terms.

Your Input

You retain all rights you hold in any text, images, files, or other content you provide to the RGBKit AI Platform ("Input"). You are solely responsible for ensuring you have all necessary rights, licences, and permissions to use the Input.

Generated Output

Content generated by the RGBKit AI Platform in response to your Input ("Output") is provided to you subject to these AI Terms. To the extent permitted by applicable law, ownership of Output rests with you. However, you acknowledge that:

• Similar or identical Output may be generated for other users — RGBKit does not guarantee uniqueness.
• Output may not be eligible for copyright protection in all jurisdictions.
• RGBKit makes no representations about the intellectual property status of any Output.
• You are solely responsible for any use you make of Output.

Restrictions on Input and Output

Both Input and Output must not:

• Violate any applicable laws or regulations.
• Infringe any third-party intellectual property, privacy, or publicity rights.
• Violate RGBKit's Terms and Conditions or Community Guidelines.
• Contain or generate harmful, deceptive, defamatory, or unlawful content.

You may use the Output for any lawful purpose, but all responsibility for this use lies with you. RGBKit provides no guarantees regarding copyright ownership claims for Output or that the Output will not infringe third-party intellectual property rights.

If you use our AI Image Generator or other tools, your Input and Output may be publicly viewable and remixable by default. You are responsible for ensuring Output is suitable before publishing, distributing, or using it commercially.

You must not use the RGBKit AI Platform to generate, process, or distribute content that:

• Is sexually explicit, pornographic, or involves minors in any sexual context.
• Promotes, glorifies, or facilitates violence, terrorism, or self-harm.
• Harasses, threatens, or intimidates any individual or group.
• Spreads disinformation, propaganda, or deliberately misleading content.
• Creates deepfakes or synthetic media designed to deceive or defame real individuals without their consent.
• Infringes on third-party trademarks, copyrights, or other intellectual property rights.
• Facilitates illegal activities including fraud, phishing, or identity theft.
• Attempts to reverse-engineer, extract model weights, or circumvent safety measures.
• Is used for automated bulk generation for spam or low-quality content farms.

By using the RGBKit AI Platform, you grant RGBKit a perpetual, worldwide, royalty-free, sublicensable, irrevocable, and non-exclusive licence to:

• Store, process, reproduce, and use your Input solely to provide, maintain, and improve the RGBKit AI Platform, including for training and fine-tuning of AI models used within the platform or by third-party AI providers engaged by RGBKit.
• Host, display, reproduce, and distribute Output to deliver the service to you.

You may opt out of having your Input used for AI model training by contacting us at rgbkits@gmail.com. Note that opting out does not affect processing already performed.

The RGBKit AI Platform is powered by third-party AI models and infrastructure providers, including but not limited to:

Your Input may be transmitted to these providers' APIs for processing. Each provider has their own terms and privacy policies which also apply. By using RGBKit's AI features, you consent to this transmission.

The RGBKit AI Platform relies on various third-party AI models to generate Output, and both the platform and the Output are provided "as is," without warranty. RGBKit does not guarantee the accuracy, reliability, non-infringement, or suitability of Output for specific purposes. Use of the Output is at your own risk, and RGBKit holds no liability related to or arising from your use of the RGBKit AI Platform or Output.

Due to the evolving nature of AI, Output from the RGBKit AI Platform may vary and may occasionally produce offensive, harmful, or inaccurate content. By using the platform, you accept this risk and agree not to save, share, or distribute content that violates RGBKit's Community Guidelines.
